His civil litigation practice is quite varied, and it encompasses motor vehicle accidents, defective products, medical malpractice and other plaintiff’s personal injury matters, breach of contract actions, construction disputes, insurance bad faith and class action lawsuits involving mass torts. Most recently, Gary Yarborough, Jr., served as class counsel for the State of Mississippi representatives in the antitrust litigation against Keurig. Yarborough also serves as associate class counsel in the litigation against the Coca-Cola Company related to its mislabeling of its signature Coca-Cola products and improper inclusion of phosphates, which have shown to cause heart and other health problems. https://www.law360.com/articles/1244376/coke-buyers-get-partial-class-cert-in-false-ad-mdl.

Yarborough also serves as associate putative class counsel in the actions against Starkist Tuna, Bumble Bee Tuna and Chicken of the Sea, for antitrust violations and rigging of prices of cans of tuna. The would be competitors, as alleged, conspired to rig and set their tuna products above market price. Related to that litigation, Bumble Bee sought bankruptcy protection in the federal bankruptcy court of Delaware. Yarborough was appointed and served on the five person unsecured creditors committee, which were parties to the $1 Billion Dollar bankruptcy. See In re: Parent Bumble Bee Company, Inc, Case No. 19-12502 (LSS) (Bank. DE 2019). Yarborough serves to protect the interest in that proceeding of not only his putative S.D. California class against Bumble Bee, but also all unsecured creditors.

In one representative matter, Mr. Yarborough was co-counsel in a lawsuit filed against an insurance company for losses related to Hurricane Katrina that resulted in a jury award of nearly $1 million. He has also obtained a $4.9 million jury award in a case brought against Lloyd’s of London for its failure to pay out insurance claims. Mr. Yarborough’s track record has also included the representation of plaintiffs in complex medical and pharmaceutical malpractice cases, resulting in several settlements in excess of $1 million.

In addition to his private practice, Mr. Yarborough serves as the County Attorney for Hancock County, Mississippi, a position he has held since his 2014 appointment. He also previously served as counsel for the City of Waveland, from 2010 to 2017.
